
Purchasing your first home is a major milestone. During your search, you may find two options: a unit in an under-construction tower and a unit in a fully completed tower adjacent to it. While under-construction properties often offer lower base prices, you must account for significant GST implications that can drastically alter your total cost.

1. The Core Rule: “Service” vs. “Immovable Property”
Why does the government tax a half-finished flat while fully constructed property remains tax-free? The distinction lies in legal definitions.
- Under-Construction: While a flat is under construction, you have not yet purchased a piece of property. Instead, you are hiring a builder to provide a “construction service.” Because this is classified as a service, GST applies.
- Ready-to-Move: Once the construction is complete and the local municipal authority issues an Occupancy Certificate (OC) or Completion Certificate (CC), the unit becomes “immovable property.” Under the GST Act (Schedule III), the sale of land and completed buildings is not subject to GST.
2. Under-Construction GST Rates (The 1% vs. 5% Rule)
If you purchase an under-construction property, you pay GST on every milestone payment made to the builder. The rate depends on whether your flat qualifies as “Affordable” or “Non-Affordable.”
- Affordable Housing (1% GST): To qualify, your property value must be ā¹45 Lakhs or below. Additionally, your carpet area must not exceed 60 square meters in metropolitan cities (Bengaluru, Delhi NCR, Mumbai) or 90 square meters in non-metropolitan cities.
- Standard / Non-Affordable Housing (5% GST): If your property is valued at ā¹46 Lakhs or more, or if it exceeds the carpet area limitations, it falls into the standard category. You will be liable for 5% GST.
- Note on Input Tax Credit (ITC): Builders cannot claim ITC for residential projects under these 1% and 5% schemes.
3. Ready-to-Move Properties (The 0% Advantage)
The GST rate is 0% if you purchase a flat in a building that has already obtained an Occupancy Certificate (OC).
- The Trap: Some builders may attempt to charge you GST even after the OC is issued, claiming “pending works.” Do not pay it. Once the OC is issued, the supply is completely exempt from GST.
- Other Costs: While you avoid GST, you must still pay Stamp Duty and Registration charges, which apply to all property transfers regardless of the construction stage.
4. Commercial Properties and Plotted Land
Rules differ significantly for non-residential investments:
- Commercial Under-Construction (12% GST): If you purchase an under-construction shop, office space, or warehouse, you pay 12% GST.
- The Advantage: Unlike residential buyers, if you are a GST-registered business purchasing office space for commercial use, you can claim the 12% GST paid as Input Tax Credit (ITC).
- Pure Land / Plots (0% GST): The purchase of bare landāeven in a gated community with roads and drainageāis not considered a construction service. Therefore, GST is not applicable.
Calculate Your True Cost
Under-construction properties are typically 10ā20% cheaper than completed properties. However, you must weigh the base price plus 5% GST against the cost of renting while waiting for construction to finish. Often, a “more expensive” ready-to-move property may actually be the more cost-effective choice once GST and rental costs are factored in.
Don’t overpay for your real estate investment. A simple categorization errorāsuch as misidentifying affordable housing or failing to verify the date of the Occupancy Certificateācan cost you hundreds of thousands of rupees.
