
While calling a business a “startup” carries marketing appeal, the term carries a very specific legal definition within the Indian government. Instead, you must receive official recognition from the Department for the Promotion of Industry and Internal Trade (DPIIT).
In February 2026, the government issued a major new notification (G.S.R. 108 (E)), which completely revised startup recognition criteria. These updates expanded turnover limits, introduced a dedicated “Deep Tech” category, and moved the application process to a centralized portal.

1. New Eligibility Criteria (2026 Rules)
To receive a DPIIT Certificate of Recognition, your business must satisfy four core criteria:
- Entity Type: You must be a Private Limited Company, Limited Liability Partnership (LLP), a registered Partnership Firm, orāas of the 2026 updateāa registered Cooperative Society. Note that sole proprietorships remain ineligible.
- Originality: You cannot qualify if your business formed via the division or reconstruction of an existing business.
- Age Limit: Your company cannot be older than 10 years from the date of incorporation.
- Turnover Cap: Your company’s turnover must not have exceeded ā¹200 Crores in any financial year since incorporation (previously, the limit was ā¹100 Crores).
The “Deep Tech” Upgrade
The 2026 regulations recognize the longer commercialization cycles required for research-intensive industries (e.g., aerospace, biotech, semiconductors). If your company is a “Deep Tech Startup”āmeaning you are research-intensive and create proprietary, scientifically advanced solutionsāthe government provides significant relaxations:
- Longer Recognition Period: Deep Tech startups may receive recognition for up to 20 years from incorporation.
- Enhanced Turnover Limit: The turnover limit for Deep Tech startups is set at ā¹300 Crores.
2. What Does DPIIT Recognition Provide?
With the removal of the “Angel Tax” in the recent Union Budget, the focus of DPIIT recognition has shifted toward operational efficiency and intellectual property (IP). Once certified, you are entitled to:
- Significant IPR Subsidies: The government will cover the costs of IP facilitators, providing an 80% subsidy on patent fees and a 50% subsidy on trademark fees. Furthermore, the government significantly expedites the examination of your patent applications.
- Access to GeM (Government e-Marketplace): Most government contracts require “previous experience” and high “minimum turnover” standards. DPIIT-recognized startups are exempt from these requirements, allowing young companies to win public procurement contracts.
- Self-Certification of Labor Laws: Startups can self-certify compliance with nine different labor and environmental laws. For the first five years, you receive immunity from routine, arbitrary government inspections.
- Gateway to the Tax Holiday: As discussed in our previous articles, DPIIT recognition is the mandatory first step if you wish to apply for the 3-year income tax holiday under Section 80-IAC before the Inter-Ministerial Board.
3. How to Apply via the NSWS Portal
Gone are the days of using the old Startup India portal. The government now requires all applications to be submitted through the National Single Window System (NSWS).
The application undergoes rigorous scrutiny. You must submit a comprehensive pitch deck and a detailed write-up explaining your innovation. If you merely state that you are “selling clothes online” or “building a standard CRM,” you will likely face rejection due to a lack of scalability or innovation. You must prove, beyond a reasonable doubt, that your startup utilizes disruptive technology, generates wealth, and creates employment.
