Senior Citizen Tax Savings & Pension Exemptions: Advice by CA PAVAN KUMAR AND CO

Introduction

As one retires, earnings become less predictable and more complex, requiring a different approach to tax planning. Many senior citizens have varied income sources including pension, interest, rents and capital gains. To simplify tax compliance and improve tax planning, it is useful to understand how each of these is taxed.

In Bangalore, for senior citizen tax planning to be effective, a number of other factors must be evaluated, including the senior citizen’s other income and deductions, the tax regime chosen, expected expenditure and retirement income, and the senior citizen’s residential status.

Tax planning for pensioners, senior citizens and high net worth individuals, and NRIs with income in India, is complex and requires the services of a tax consultant.

We, at Pavan Kumar & Co. (Chartered Accountants) have been in the practice of providing tax, accounting, audit and other allied services to individuals and businesses since 1985. We understand the needs of our clients in India and help them implement practical and appropriate financial strategies.

Tax laws are dynamic. Provisions of the law that are in force at the time of assessment of a taxpayer are binding.

The term ‘Senior Citizen Tax Planning’ refers to employing various provisions of the tax law to structure the finance, investments and deductions of a senior citizen in a way that is legal and minimizes tax outflow.

There are various forms of retirement income, for example:

Pensions

Interest

Rental Income

Dividends

Capital Gains

Annuities

Another consideration is income from a business or profession. Of course, some people may also have investments located outside of India, which would also be an additional source of income.

For good retirement tax planning, all of the facts need to be taken into account, rather than considering individual details in isolation.

Pension income in India is taxable. There is a common myth that pension is not taxable.

In the case of an employee, the taxability of pension depends upon the terms of the retirement agreement and other circumstances. For example, if pension has been paid out as family pension, it may be taxable as income from other sources.

Because of the varying taxability of pensions in India, pension tax planning is a key component of retirement tax planning.

The taxability of pension paid to an employee depends upon the terms of retirement. For example, if the pension is paid out as a lump sum, or if the retirement agreement stipulates that the pension will be paid for a fixed term, it will be taxable as salary income.

From AY 2026-27, the ITR validation rules of CBDT would distinguish the limit of family pension deduction under section 57(iia). Under the old regime, the family pension deduction was limited to the lower of (i) one-third of the family pension and (ii) Rs.15,000.

The limit for the new regime is different and CBDT’s rules allow a family pension deduction of one-third of the family pension but with a limit of Rs.25,000.

Generally, it is Advisable that taxpayers seek the advice of a tax professional regarding any tax exemption or tax deduction claim.

Know More About Section 80TTB

One of the provisions which is of interest to the senior citizens is Section 80TTB.

As per Section 80TTB, a senior citizen is permitted to claim a deduction of up to Rs.50,000 in a financial year, for the interest income which is charged to tax in his/her hands. In order to claim the deduction, certain conditions must be satisfied.

The Income Tax department of India has clarified that both, the savings as well as fixed deposits, are within the ambit of this provision.

This Section, however, does not provide for a mandatory tax saving of Rs.50,000 to senior citizens.

In case of a senior citizen, the residential status, the nature of income and the tax regime chosen are to be considered. The view of the department and CBDT’s validation rules, for the financial year 2026-27, indicate that this deduction is available only under the old tax regime, and the deductions under Chapter VI-A, of which Section 80TTB is to be available under the new tax regime.

This, no doubt, adds another dimension to the importance of taking expert tax service of senior citizens Bangalore.

Other Tax Considerations for Senior Citizens

Medical Expenses and Insurance

There are provisions regarding health insurance and medical expenses where senior citizens are given a higher limit, state by state, and are implemented based on the given tax structure.

As regarding the Income Tax Department for the AY 2026-27, there is a provision to give a senior citizen a higher limit under Section 80D if certain conditions are met.

Advance Tax

A senior citizen, who does not carry on any business or profession, is exempt from paying advance tax under Section 207 of the Income Tax Act, 1961 (the Act), subject to the conditions provided under the Act.

This is relevant to senior citizens who do not have any income from business or profession and only get pension, interest, rent and other such income.

Choice of Tax Regimes

The old tax regime provides for more deductions than the new tax regime and vice versa.

Section 80TTB is only available under the old tax regime for the AY 2026-27.

Thus, while doing the income tax planning for senior citizens in Bangalore, both the tax regimes have to be analyzed to see the benefits available to the taxpayer.

Who Should Consider Professional Senior Citizen Tax Planning?

People in the following circumstances may find it worthwhile to engage a professional for tax planning:

Former salaried employees

Persons having inherited wealth

NRI’s with income from India

For the former, the tax planner may look into a wide range of issues including, but not limited to, his tax planning, wealth creation and management, investments, inheritance tax planning, employee stock option plans (ESOPs), capital gains tax, trusts and estates, and succession planning.

Depending on the nature of a tax payer’s income, the following may be produced to a tax planner.

  • Is treatment of family pension different from normal pension?

Yes. Family pension is lump sum and is taxable under the head “Income from Other Sources”. However, it is allowable as deduction under section 57(iia) of the Act, if it is in accordance with the limit of deduction and the prevailing tax regime. The limit of deduction under the two tax regimes for assessment year 2026-27 is different.

  • Should senior citizens take note of both the old and new tax regimes?

Yes, it is necessary to take a note of both the tax regimes as which regime is suitable for a tax payer would depend on the income of the tax payer, other exemptions and deductions available to the tax payer and other circumstances. For example, Deduction under Section 80TTB is available only under the old tax regime.
